The draft law, which is planned to be adopted in 2019, provides for retirement after 25 years of service and a pension of 65% of the salary.

For each year over, there will be an increase in the military pension by 3%, but its maximum size cannot exceed 95% of the employee's earnings.

Dismissal from the armed forces can occur for one of the following reasons:

  • reaching the age limit for serving in the Ministry of Internal Affairs;
  • a disease that interferes with continuing to serve;
  • staff organization activities (including reductions).

As a result of retirement on such grounds, a citizen will receive a pension in the amount of 50% of the allowance if he has 20 years of experience. For each additional year there will be 3%, but their total amount cannot exceed 95%.

For the military

The increase in the required length of service will also affect servicemen. Pensions will be assigned to them on the same conditions as to employees of the Ministry of Internal Affairs.

The norms of the bill provide for a transitional period until 2023, during which the military will be able to resign on the same terms.

The law provides for the appointment of a minimum pension in the amount of 65% of the salary, and a maximum one - 95%. Also, this bill does not contain a provision on seniority allowances. It is assumed that it is simply not provided for, due to the lack of the necessary funds in the budget of the department.

The latest news on the pension reform of the military

For 2018, various forums are discussing the upcoming reform in the military sphere. In order to somehow prepare citizens for such a turn of events, Vladimir Putin said that in the near future the growth of military pensions will grow by 6%.

As early as January 1, 2019, the Government of the Russian Federation promises that it will start implementing a large-scale pension reform that will affect all segments of the population and spheres of activity. It is planned to adjust the conditions under which retirement is possible, and the retirement age will also be raised to receive an insurance pension upon reaching a certain age.

At the same time, the possibility of making changes to the conditions for calculating pensions to security officials remains in question. The government does not comment on future amendments in any way. But there is a possibility that they will be introduced soon.

Representatives of the State Duma report that the length of service for the military and security officials will be increased, but a little later, so as not to create confusion among citizens.

In view of this, it is not yet known how and how the military pensions will be adjusted, whether the length of service will increase, and most importantly, how much. Also, no official documents have been submitted for publication. But the authorities do not deny that changes in pension provision for the security officials will still be carried out, it is only a matter of time.

Under the new legislation, it is planned to increase the amount of monetary allowance. Its value will increase from 50 to 65%.

A serviceman who has more than 25 years of service will be offered to pay a supplement of 25% of the pension that he could receive in a situation if he quit military service. For each year, the amount of the premium increases by exactly 3%... But retirement will mean a complete recalculation of the total amount of earnings.

At the same time, citizens retain the right to retire to a military pension after 20 years of service. However, this is only possible in a number of individual cases.

Unfortunately, at the moment there is no publicly available publication of the text of the draft law for review. You can read the main postulates of the law and its theses only through the analysis of the media in unofficial sources. Some provisions of the law are cited here, and the main ideas of the new act are also discussed. At the moment, there is no official information on the exact content of the bill, which will be finally adopted.

Specificity of the new draft law on raising the retirement age

What will be remarkable about this bill?

To date, it has been established that if a serviceman has 20 years of service, then he is already assigned a pension, which is equal to 50% of the available monetary allowance.

Every year from the moment of reaching 20 years of service, the annual increase will be 3% to the already existing amount of 50% of the allowance. But the total amount of the allowance cannot exceed 85% of the original salary of a soldier.

The bill proposes to revise this approach. Pension benefits will begin to accrue at the time when the service record reaches 25 years. Not 50, but 65% will be credited at once. Each year, 3% of the pension will be accrued, and the maximum amount should not exceed 95% of the salary of a soldier.

The bill offers several options for dismissal from the armed forces on one of the preferential grounds:

  1. Reaching the legal age beyond which it is impossible to serve in the armed forces.
  2. In connection with the implementation of organizational and staff activities and the subsequent reduction.
  3. Illness or serious health condition that does not provide for being in the ranks of the armed forces and is confirmed by a medical commission.

In such a situation, in accordance with the draft law, it will be provided for the appointment of a seniority pension, the value of which will be equal to 50% of the funds received, provided that the soldier has at least 20 years of service.

Every year he will be added 3%, but the amount of the received allowance cannot exceed 95%.

The specificity of the law is that it was adopted with the aim of eliminating the unfairly established high retirement age for ordinary citizens of the country who were not involved in military service. That is why the term for the military was also increased to 25 years.

The bill itself was developed by the Main Directorate of Personnel of the Armed Forces.

More recently, it became known that this regulatory legal act has already been signed by the President of the Russian Federation and should enter into force in 2019.

Adoption of the law on increasing the length of service for military personnel

To date, official sources do not indicate when the law will be adopted, and when the mention of the new length of service will begin to operate. The process has not been defined, which will imply a transitional phase, which should last until 2023.

Citizens who will be subject to the new regulatory legal act can retire even if they have a service record of 20 years, but subject to special conditions that will be valid until 2023.

Many media outlets claim that the approval of the project was completed in a positive way. The decision on the issue of increasing the length of service has already been made, and the entry into force of the legislative act is only a matter of time.

The adoption of the project was scheduled for September 2018. But due to the complex issues of the pension reform for civilians, the bill for the military has been shelved.

The principle of calculating military pensions

In accordance with the bill, the principle of calculating the military pension will not change. Only the indicators that will participate in calculating the total amount will change.

The calculation principle is very simple. It is necessary to take the total value of the EDBI, which, in addition to the official wages, also includes all the allowances. With the help of this value and the characteristic pension coefficient, you can find out the approximate amount of the pension, which must then be compared with a reduction coefficient.

When calculating a pension, the following indicators are taken into account:

  • Salary for the awarded title.
  • Salary from the corresponding position held.
  • Supplements, in the amount not exceeding 40% of the EDB.

The formula looks like this.

It is still vaguely clear how the calculation of the military pension will be carried out from 2019. After all, not all provisions of the new bill will be adopted immediately, which means that the calculation system should also be somewhat modified.

It is planned that at first, military personnel will be able to calculate an approximate pension using special online calculators. Later, a generally accepted formula will appear.

Let's consider how the payout for military personnel in 2018 is calculated. The calculation rules are regulated by the Federal Law “On Pension Provision of Persons in Military Service” 4469-1.

Example: A. Odintsov was dismissed from the army with the rank of captain. The reason for the dismissal was the end of the contract. Odintsov is 44 years old. His experience is 24 years and 6 months. This confirms the length of service. As a result, the payment will be calculated as follows:

A completely different calculation is assumed if a citizen has been in military service for less than 20 years.

Cancellation of the reduction factor for military pensioners

The law promises to consider requirements for the abolition of the reduction factor. More than once the issue of introducing a reduction factor was checked for legality in the Constitutional Court. However, no violations of the constitutional rights of servicemen were found.

To date, the value of the reduction coefficient is equal to 72, 23% of the monetary allowance.

The ratio indicator has not changed since 2017. After the entry into force of the bill, they promise to either freeze the reduction factor or increase it slightly. However, there is also a possibility that when discussing the prospects of the decreasing coefficient, it will be decided to abandon it altogether. However, it makes no sense to talk about this innovation until 2023.

What will happen to the military pension in 2019?

In 2019, it is planned that a reform will start working, which will also affect innovations in the issues of pensions for military personnel. It is planned that the changes will be quite controversial, but necessary.

The length of service will increase from 20 to 25 years... This innovation has already been officially approved. Such a reform will avoid inequality in the country and will equate civilian retirees with the military.

It is possible that the moratorium established in 2018 on changing the reduction factor will be lifted.

Indexation can also be expected. According to the official statements of the Ministry of Defense, retirees can count on a two-stage increase in social benefits.

  1. The first stage will start on October 1, 2019.
  2. The second stage is exactly one year later, in 2020.

But the value of the reduction factor should remain at the same level, and also correspond to the current salaries of military personnel.

In order to carry out the reform, 41 billion rubles have already been frozen in the state budget. Thanks to these funds, the Government plans to support military pensioners, as well as to jinx the transition process in the face of inflation.

The law on increasing the minimum length of service will be passed, but everything will not happen overnight. The transition process will last exactly 5 years until 2023. During this time, work will be carried out of a financial, economic and social nature, which will help citizens adapt to the new conditions.

The real reason for raising the retirement age for military personnel, according to many citizens, is simply a banal leveling. In accordance with the Federal Law "On the Status of Servicemen", the military acquire the right to a pension 20 years after they began their military service. That is, many citizens can become full-fledged pensioners at the age of 40.

Many citizens of the Russian Federation and deputies disagree with this. Not yet knownwhether the changes reported by Anton Siluanov will be made according to this bill, which was actively discussed in 2017, or some other version of the adjustments will be proposed. But the very fact that the Cabinet plans to submit its proposal regarding the service life of military personnel and security officials (Ministry of Internal Affairs, FSB, Ministry of Emergencies, etc.) is no longer denied.

Draft law on increasing the length of service to 25

The draft law discussed in 2017 in a number of media outlets providing for the reform of the pension system of servicemen, as reported by the Kommersant publication at that time, was prepared in order to fulfill the order of the President of the Russian Federation Vladimir Putin No. Pr-497 dated 17.03.2017. The text of the instruction in question , in any official sources not published (as, in principle, the bill itself). However, this did not prevent its active discussion.

According to the text of the document, which came to the disposal of the media, changes in the pension system for the military and security officials were to enter into force on 01.01.2019 and contain the following provisions:

  3. Due to organizational and staff activities.

The official publication of the text of this bill did not happen - it was distributed only through the media (unofficially), in which some of its provisions were discussed and quoted. But no denials from the Government, as well as any comments on this matter, have been reported. Therefore, at the moment there is no official information on the content of the bill, which can be adopted in the final version.

What will happen to the military pension in 2019?

Discussion of issues related to changes in the military pension system occurs regularly. Which of the voiced expert proposals will be approved and implemented by law? not yet known.

It can be said unambiguously that the authorities, along with pensions paid through the Pension Fund of Russia (PFR), also intend to reform the pension system of servicemen in one form or another (this point is no longer denied). Back in 2015, Finance Minister Anton Siluanov noted the need to return to the discussion of the issue of increasing the length of service, which will allow a serviceman, an employee of the Ministry of Internal Affairs, the Ministry of Emergency Situations and other law enforcement agencies to retire. As noted earlier, one of the possible suggestions - the length of service for the military can be increased from 20 to 25 years.

In addition, the question was discussed increasing the service life of officers - President Vladimir Putin announced this on his regular Direct Line in 2017. At the same time, he approved a list of instructions, among which (clause 9 of Pr-1180) was one, addressed to the RF Ministry of Defense, on the need to consider the issue of increasing the age limit for military service. However, the draft law providing for such an adjustment was not published either.

Also, a lot of noise among the servicemen was made by the proposal of a member of the collegium of the Ministry of Finance, Vladimir Nazarov, who proposed it in 2016. This proposal was also never formalized in the form of a bill and was discussed only in the expert community. In fact, it was proposed to replace military pensions with a social contract with the following provisions:

  • provide, upon dismissal from military service, the payment of a one-time monetary compensation (severance pay), which would allow a serviceman to provide a decent life for several years;
  • in the future, retraining and employment in the civilian profession was supposed.

That is, in this version, the concept of a "military pensioner" as such could generally become a thing of the past - all servicemen, employees of the Ministry of Internal Affairs, National Guard and other law enforcement agencies would retire upon reaching the generally accepted civilian specialties or, if the state of health would not allow them to continue further labor activity, would be formalized.

Based on the standards of this legislation of the Russian Federation, servicemen, in addition to their salary, may receive additional benefits. Highly qualified employees receive financial benefits for seniority, paid along with their salaries.

Pension contributions to servicemen for seniority can increase, but taking into account the reduction in the number of pensioners itself, this increase will hardly concern anyone.

Until the bill on the length of service of 25 years of servicemen to receive a pension does not enter into force, most citizens will still need to take into account mixed length of service, that is, calculate both the time spent on military service and work in civilian specialties.

Reasons for change

Benefits must be calculated for the number of employees in the Ministry of Internal Affairs in the near future. For this reason, additional financial resources are required on an ongoing basis.

Each year, about 400 billion rubles will be allocated from the Russian budget to the Ministry of Internal Affairs. In addition to salary payments and pension contributions, the power structure needs to constantly update equipment, train new workers to provide full protection to the population.

Review of the legislative initiative

Based on the law on the provision of pensions for military personnel, as well as employees of the internal affairs bodies, the National Guard and the Federal Penitentiary Service, they are able to go on a well-deserved rest after a certain length of service in a situation where their period of work is at least 20 years.

The period of service for the transition to the status of a pensioner of employees in the military structures must be adjusted, as stated by Deputy Prime Minister, Minister of Finance of the Russian Federation Anton Siluanov.

Government bodies are talking about the introduction of a transitional period for increasing the age of a pensioner, which they want to start in 2019, so that the transition to pensioner status is gradually achieved at 65 years for men in 2028 and 63 years for women in 2034.

As compensation, it is proposed to provide for the likelihood for every citizen who has work experience - 40 years for women and 45 years for men - to retire 2 years earlier. The Prime Minister sets the task of introducing a draft pension reform to the State Duma in the fall.

As for the military, an employee receives legal authority to retire after 25 years of service. This legislative draft may come into effect as early as 01.01.2019.

Work on a project, according to which an employee will need to serve before receiving legal authority to provide a pension, is being developed and is already undergoing all the necessary interdepartmental agreements.

Will the size of pension payments increase?

In 2019, the amount of additional payments for any categories of employees in the plans should change and increase based on federal law. Upon resignation from service before January 1, 2019, the right to a certain length of service will be retained taking into account the past legislative draft.

Each additional payments will be indexed based on the new document and the amendments made to it.

To begin with, it is planned to introduce a provision on an allowance in the amount of 1/4 of the standard pension for those servicemen whose seniority begins at the beginning of the year.

The bill has not yet been put into effect, and its stages are under preliminary discussion. The main reason for the possible introduction of the law into force is the lack of budgetary funds for further payments to military pensioners.

Specificity of the new draft law on raising the retirement age

At the moment, for an experience of 20 years, a serviceman is assigned a pension, which is 50% of the monetary allowance. The annual increase in the 20th term of service is 3% of the above-described allowance, however, the allowance cannot exceed 85% of the military's salary.

In the new draft law, 65% is charged for 25 years of service, and another 3% for each year exceeding the minimum length of service, but the maximum amount of security should not exceed 95% of the allowance.

A soldier can resign from the armed forces on one of the provided preferential grounds, which include:

  • reaching the maximum age for serving in the armed forces;
  • a disease confirmed by a military medical commission;
  • organizational and regular activities.

In this case, it provides for the appointment of a seniority pension, the value of which will be 50% of the above-described financial resources, subject to the presence of 20 years of service, and 3% for each year exceeding it, but not more than 95%.

The federal law, which provides for an annual increase in salaries for the position and for the rank, has not been enforced for a long time. Since 2013, the increase in the provision of the military has been due to a reduction factor. Its annual growth is spelled out in legislative acts (in 2017 it was equal to 72.23%), thanks to it, over 5 years, pension benefits increased by 30%.

Adoption of the law on increasing the length of service for military personnel

It is still unclear when the law will be adopted and the new length of service will begin in 2018 or from 2019. It also defines a transitional stage, which should last 5 years until 2023.

Citizens who are subject to the action described in the legislation of February 12, 1993, have the right to retire if they have 20 years of service on special conditions, functioning until the new project comes into effect from January 1, 2023. Now such a rule is spelled out in the bill, but how everything will turn out after the official adoption of the normative legal act is unclear - it is quite possible that the provision will be canceled.

The presidential administration notes that the departments need to hold a number of conferences of a financial, economic and social nature in order to make final amendments to Articles 13 ("Conditions determining the right to a seniority pension") and 14 ("Pension rates") of Law No. 4468 -I.

Conducted opinion polls show that more than 80% of the people surveyed do not support an increase in the length of service for military personnel, so it is far from a fact that such a painful event will pass completely calmly.

The principle of calculating military pensions

The principles for calculating pensions are reflected in the law of 12.02.1993 No. 4468-1 "On Pension Provision".

Military retirees can receive a seniority or disability pension. In addition, family members of a deceased (deceased) soldier have the right to receive a survivor's pension.

In all cases, the basis for determining the amount of the pension is the serviceman's money allowance, i.e. his salary, taking into account all allowances.

The seniority pension is established in two cases:

  1. With a length of service of 20 years or more.
  2. With a general work experience of more than 25 years, of which more than 12.5 years is the length of service in military or equivalent service.

Pension for minimum service or seniority in both cases is 50% of the pay. If the length of service exceeds the minimum, then in the first case, 3% is added for each additional year over 20 years (but not more than 85% of the amount of the allowance). In the second case, with “mixed” seniority, 1% is added for each year after 25 years (Art. 14 of Law No. 4468-1).

Cancellation of the reduction factor for military pensioners

Demands to abolish the reduction factor appeared almost immediately from the moment of its introduction and continue to this day.

The legality of the introduction of this norm has been repeatedly checked by the Constitutional Court, which did not find any violation of constitutional rights in it (this is indicated, for example, by the rulings of 17.07.2012 No. 1433-O and of 24.09.2012 No. 1800-O). The Court refers, in particular, to the fact that, due to the increase in the base (i.e., the official salaries), the absolute amount of pensions has not decreased. In addition, the law provides for a mechanism for a gradual increase in the coefficient, and hence pension payments.

The issue of canceling the reduction factor was also raised in the State Duma. The corresponding bill proposed by the Communist Party faction was considered in February 2017 and rejected.

In addition, as mentioned above, the current growth of the coefficient has also been suspended for 2018.

The likelihood of canceling the reduction coefficient on pensions for military pensioners in 2018 is very small. Most likely, an increase in military pensions in the near future will occur only due to an increase in monetary allowances, which is included in the budget for 2018-2020.
