Financial assistance to former employees and retirees

The provision of material support by the employer to retired or former retired employees is carried out on the basis of the provisions of the collective agreement.

There are grounds provided by law for providing financial assistance to retired employees:

Expensive treatment associated with serious illnesses of a retired employee;

Retirement due to age or disability after a long time of work in a given organization.

In order to receive one-time financial assistance, a pensioner must write a corresponding application to the employer (in free form) with a request to provide him with financial assistance. The application must indicate the reason for requesting assistance. If the manager makes a positive decision on this application, then an order is issued on his behalf to provide financial support to the employee (there is no unified form, it is drawn up in free form).

In accordance with Art. 270 of the Tax Code of the Russian Federation, the amount of material support cannot be included in expenses when determining the tax base for calculating income tax, but there is no clear definition of what kind of material assistance fits this definition. If the form of financial support an organization provides to its employees is not related to their work responsibilities, but is aimed at meeting the needs associated with difficult life situations, then these amounts can be included in expenses.

Insurance premiums are not charged for the amount of one-time financial assistance, which is provided no more than once a year and in an amount of no more than 4 thousand rubles, if:

It is provided to persons who have suffered natural disasters;

In the event of the death of a loved one;

In case of birth (adoption) of a child.

In all other cases, the employer must pay insurance premiums on amounts of financial assistance in accordance with Federal Law No. 212-FZ of July 24, 2009. Let us recall that it is valid until the end of 2016. However, the new chapter of the Tax Code of the Russian Federation on insurance premiums does not differ much from the principles of Law No. 212-FZ.

The amount of one-time financial assistance in the amount of no more than 4 thousand rubles provided by an employer to a retired employee or a former employee who is now retired is completely exempt from personal income tax.

When submitting documents by any method, you must remember that a response about the decision must be received no later than 10 days.

What documents need to be submitted?

There is a mandatory list of documents that will have to be submitted in any case:

  • an application, usually written in free form, or an institution form is provided;
  • passport (copy);

Additionally, depending on the type of assistance requested, you must collect:

  • birth certificate;
  • certificate for the child issued by the registry office, form 24;
  • certificate for the child issued by the registry office, form 25 (if paternity is unconfirmed);
  • a certificate stating that the second parent did not receive this payment;
  • a copy of the work book;
  • certificate of family composition, form 9;
  • pension/disability certificate;
  • package of supporting documents (certificates of income of all members);
  • pregnancy certificate;
  • WWII veteran certificate;
  • document on divorce and/or deprivation of parental rights;
  • documents on adoption or taking a child (several children) into care.
