After the adoption of changes to the Housing Code, regional authorities were able to provide certain benefits to pensioners who were 70 years of age or older to pay contributions for major repairs. This category of citizens receiving compensation payments intended to pay for the costs of major repairs includes single elderly people who have reached seventy years of age and older.

In order to receive benefits, you need to write an application that will be considered by social security authorities.

The registration procedure depends on whether the applicant has submitted an application for the provision of services or not. There is no automatic exemption from the payment of such contributions for capital repairs.

This benefit is provided:

  1. Single pensioners over 70 years of age and retired due to age.
  2. People of retirement age living with someone. In this case, the age limit remains at 70 years. The pensioner must be registered in this living space, and the remaining registered persons must also be non-working pensioners. If any family members continue to work, compensation will be denied.

The new changes spell out provisions for when a non-working pensioner lives together with a disabled person who is unemployed or with a family member who has not reached .

If previously, in case of their separate residence, this benefit was provided to each, then in case of joint residence it was absent. In this regard, a similar gap has been corrected at the legislative level, and the current change will be in effect from the beginning of next year.


Who is eligible for benefits

How to get a preferential payment

As already mentioned above, in order to receive benefits for paying for capital repairs, pensioners over 70 years of age must write an appropriate application for compensation.

In order to properly apply for the benefit, you need to pay a contribution for major repairs (in most cases it is found in the receipt for payment of housing and communal services). If there are any debts, they must all be repaid at the time of registration.

After this, you need to collect the relevant documents, including:

  1. Identification document (passport).
  2. Certificate of ownership (USRN, extract).
  3. Pension certificate and.
  4. Certificate confirming family composition (degree of relationship).
  5. Documents confirming the absence of debt for housing and communal services.
  6. Receipt confirming payment for housing and communal services.
  7. An extract from the house register (about everyone who is registered in this living space).
  8. A work book confirming the status of a non-working pensioner.
  9. Bank account details with a card linked to it.

All of the above documents can be submitted to the following organizations:

  1. To the social protection authorities at the place of residence (USZN).
  2. At the MFC.
  3. Through the State Services website.

Once submitted, the application must be reviewed within ten days. In some cases, benefits may be denied, namely:

  1. A pensioner does not qualify for this benefit (if there are working family members).
  2. There is a debt to pay for housing and communal services.
  3. Not all required documents were provided.
  4. The pensioner already has other services.

Thus, if all specified requirements are met and all necessary documents are submitted, such a benefit for paying for major repairs will be provided without fail.

As you know, at the end of 2015, deputies of the State Duma adopted a law allowing pensioners to receive a refund on contributions for major repairs. Who can qualify for this benefit is described below.

Who is entitled to

It should immediately be noted that benefits providing for the return of funds for major repairs to pensioners after 70 years of age are provided exclusively if they are the owners of the apartment. This requirement is indicated in regulations adopted in various subjects of the federation and is contained in the Housing Code of Russia, and specifically in its 169th article. In other words:

  • Only persons over 70 years of age who are sole homeowners can apply for this benefit;
  • The rule does not apply to those pensioners with whom younger citizens also own an apartment;
  • It will not be possible to take advantage of this preference and the elderly, whose living space is registered with people under 70 years of age;
  • continuing to work.

In fact, the legislation clearly limited the circle of people who will be provided with this benefit. In other words, only single pensioners who own an apartment make sense to apply to government agencies for it.

The regulatory framework of the Russian Federation also precisely defines the concept of “cohabitation”. It covers, in particular, citizens:

  • registered at a specific address;
  • owning a share of the apartment.

Procedure for calculating contributions

The Housing Code of the Russian Federation states that contributions accrued for major repairs must be received from each apartment owner on a monthly basis. All this money is stored in a dedicated account and can be spent exclusively for specific purposes.

At the same time, money is not collected from residents for major repairs in the following cases:

  • the building will not be repairable;
  • the house is called into emergency;
  • it should be demolished in the near future;
  • They intend to seize the building and transfer it to the disposal of the municipality.

All such issues are resolved at the level of local authorities. Federal legislation determined only the general directions of preferential policy. The amount of this fee is determined by the authorities of a particular entity.

The amount of the overhaul contribution is influenced by several parameters:

  • building type;
  • its number of floors;
  • number of entrances, etc.

For example, in Moscow the average payment in the city is 15 rubles per square meter of housing. At the same time, in Russian regions, citizens pay from 2 to 9 rubles.

Who pays less for major repairs?

In general, exemption from this fee - both full and partial (50 percent) - was received by:

  • WWII veterans;
  • Heroes of the Soviet Union and the Russian Federation;
  • disabled war veterans;
  • Chernobyl victims, etc.

In addition, this list, as noted earlier, also includes citizens whose age has exceeded 70 years. However, the benefit will be relevant for them if they:

  • lonely;
  • does not work.

In this case, they can count on 50 percent compensation. Those over 80 years of age are completely exempt.

Half of the fee is also paid by:

  • disabled people, both first and second groups;
  • families with disabled children.

How to apply for a benefit

The contribution for major repairs is charged in full by default. In order to reduce its size, you must first find out whether your apartment building is on the list of buildings subject to major repairs. This kind of data will not be difficult to obtain from the management company or the HOA. In addition, you can also contact the district administration.

After this, you will need (if any) to pay all outstanding utility bills. Without this, the benefit will not be assigned. The corresponding requirement is given in Article 60 of the RF Housing Code. As a result, quite often citizens who are unable to pay for utilities on time due to difficult circumstances are deprived of the right to benefits. Despite the certain absurdity of this rule, it should still be taken into account.

Then the beneficiary will need to go to the multifunctional center at their place of residence, having with them the following documents:

  • Russian Federation passport (age will be determined based on it);
  • statement;
  • pensioner's ID;
  • a certificate confirming the absence of debts;
  • certificate of ownership of the apartment;
  • an extract about the composition of the family from the house register;
  • personal data of persons living with the pensioner;
  • receipt of payment of state duty;
  • income certificate;
  • applicant's personal account number.

In addition, it is allowed to contact social protection authorities with such a question. It is also quite convenient to resolve the issue through a website that provides government services. If all the necessary papers are in order, the benefit will be granted within 10 days.

In a situation where an elderly citizen is unable to take care of business on his own due to poor health, representatives can do this for him. They must have a power of attorney for these actions, certified by a notary.

The law specifies, in particular, that the benefit is provided in two versions:

  • partial refund of previously paid funds;
  • accrual of a special subsidy.

Thus, the possibility of direct repayment of the contribution is not provided, which often causes complaints from beneficiaries.

How are things going in Moscow?

In the Russian capital and the Moscow region, on the basis of housing legislation, the highest tariff rates for contributions for major repairs have been introduced.

In 2016, a fairly large number of residents were forced to turn to the authorities for benefits. At the same time, all citizens living here and over 70 years of age are automatically charged a contribution of 50 percent of the general rate. Other categories defined by law receive compensation on an application basis.

In Moscow, the preferential groups of citizens designated in federal legislation also include persons who have received awards for the defense of the city from the Nazi occupiers.

In December 2015, a law was introduced to abolish fees for major repairs for older people. In the first reading, it was adopted by deputies of all factions: then it was said about the release of persons over 80 years of age, whose housing complies with social norms, living alone or for married couples, unemployed.

In the second reading it was proposed to compensate expenses: for persons over 70 years old by 50%, Additionally, benefits were introduced for citizens with children with disabilities. For the latter, the social support measure was established as a return to the bank account of 50% of the amount of contributions.

So do pensioners need to pay for major repairs today? In January 2016, it was adopted with a mandatory condition for repaying the debt: if a pensioner had previously boycotted payment of fees, he will be able to receive compensation only after repaying the entire amount and is then obliged to pay regularly.

Will everyone get their money back?

Privileges are not due to everyone who has reached the age of 80, but only to those who fall under the conditions of deputies, which relate to the type of housing, type of employment, and so on.

  1. Privileges. Benefits are provided (50% of the monthly contribution) to those over 80 years of age (100% of the amount), if they do not work, live alone, are owners, do not have arrears in paying contributions, and the housing meets social standards. The benefit is calculated based on the minimum tariff per square meter of area; each subject of the Russian Federation determines its amount independently.
  2. Possibility not to pay. There is no option not to pay, since the law was modified and instead of canceling the fees, a proposal was made to return the amount of the fees, which was approved by the government.

How to write an application?

In order to do so, you must submit an application to the territorial social security authority. You can do this yourself, contact the MFC or use the State Services portal.

The form states:

  • Full name of the property owner;
  • address;
  • Account number;
  • date and signature.

  • passport;
  • documents confirming the right to compensation;
  • certificate of ownership of real estate.

Regional programs for major home repairs are designed for 25-30 years; pensioners are often forced to pay for work that has not been completed, while being in a difficult financial situation.

In the regions, the contribution is calculated based on the amount of 7-8 rubles per square meter, in the capital - 15 rubles. Failure to pay will result in penalties.

The State Duma receives many letters from pensioners informing them that they are paying contributions, and they won’t live to see the renovation itself, since their house is scheduled for another 15 years. According to the Housing and Communal Services Committee, in the Russian Federation there are 2.7 million people who fall under this category of beneficiaries.

What happens for unauthorized non-payment?
